The death of Stalisnav Thomas, a 46-year-old Roma at the hands of a Czech policeman has been described as “abhorrent, brutal and inhumane”.
The video filmed by a citizen has spread around the world. In Spain, Antena3 has broadcasted it. In the video, we can see how a Czech police officer assassinates a Roma man by putting a knee on his throat until he dies. I’ve watched the images twice because I couldn’t believe what my eyes were seeing. The unfortunate Stalisnav, lying on the ground with three uniformed madmen on him. One held his feet so he couldn’t get up. Another pushed him from behind against the ground so that he would remain with his face down while the third, kneeling next to the man, placed his damn knee on his neck and pressed his nose and mouth until he stopped breathing.
Now the policeman says the man died in the ambulance. It is a lie! There is another version: he died at the hospital. It is a lie! The witnesses who saw the murder state that the man, when he was short of breath, started to cry and then stopped moving. He remained without moving until the ambulance arrived. He was already dead.
You do not have to study a Law degree to know that we are facing a murder in which, among others, the treachery circumstances contemplated in article 139 of the Penal Code concur. If this policeman was judged in Spain, it would be possible to add the accusation discriminatory reasons – race, sex, ideology, handicap, etc. The fact that he works as a public officer would prevail.
The Czech murder is similar to the one that took place in the United States, where in similar circumstances, a policeman killed a black citizen.
The entire world was shocked when they saw the video of Minneapolis police Derek Chauvin pressing George Floyd’s neck to the ground until he died.
Regarding this assassination, we have just heard the final judgement of Judge Peter Cahill, from the Hennepin County District, in Minnesota. Derek Chauvin has been condemned to 22 and a half years of prison. The local prosecutor’s office asked for 30 years because regardless of the crime committed, the citizens of the country realized that the history of the United States was degraded by police abuses and racist attacks that were lavished too often. The other three police officers who intervened have been accused of complicity and will be judged separately in August.
We thought that would never happen again.
We believed that humanity had been immunized against racism after the horror of the Nazi genocide during World War II. However, we got shocked when, three years ago, former Italy Home Affairs Minister, Matteo Salvini, proposed to work on a census in Italy to control the Romani citizens. At the same time, the mayor of Treviso, Roberto Maroni, said he had the solution for the Roma problem: eliminate Roma children or dress them as rabbits so that the hunters could shoot at them. Others, such as Nicolas Sarkozy, former president of France, decreed in July 2010 the expulsion of the Roma from Romania and Bulgaria. The cause? Roma citizens from Saint-Aignan had been protesting after a policeman had shot and killed Luigi Duquelnet, a 22-year-old Roma who was escaping with his brother Miguel from a police attack.
Police brutality, consented to and sometimes protected by some governments, does not end here. In Spain, we still don’t know what happened to Daniel Jiménez, a Roman boy who died in police custody on June 1st in Algeciras police station. The Association of Gypsy Lawyers is working on the case and they suspect that “his death could have a cause other than suicide”.
Can Police use extreme violence against Roma?
At this point, it is not necessary to apologize in case someone thinks that I am indiscriminately accusing all the policemen. State Security forces are necessary and it is only them who can legitimately use violence to enforce the rule of law and defend citizens when their integrity or their freedoms are being attacked.
But let’s think: when governments are tolerant or look the other way when some political forces act with violence against those who do not think like them, the security forces can experience an aggressive impulse if the people in charge of regulating the use of force don’t do it.
That is the case of Hungary, that lovely land for which all Roma in the world feel affection and admiration. Today Hungary is ruled by a dangerous man: Viktor Orban. Mark Rutte, Dutch Prime Minister, and Xavier Bettel, Luxembourg Prime Minister, have invited him to leave the European Union. These winds cause storms like the one denounced, a few years ago, by the Union for Civil Liberties (TASZ). More than 50 violent actions against the Roma population have been registered in a year, according to TASZ data. Seven people have died. This chain of violence culminated with the murder of a Roma man and his five-year-old son.
Europe protests for the death of Stalisnav Thomas
German Romani citizens have already reacted. Romani Rose, leader of the Central Council of the German Roma has met with the Czech ambassador and he has delivered a letter to the Home Affairs Minister in which he states: “Our main demand is that this crime must be investigated by an independent commission and appropriate measures have to be taken when police officer have unacceptable behaviors”.
The outrage grows when we are informed that the Prime Minister of the Czech Republic, Andrej Babis, and the Home Affairs Minister have congratulated the policeman. Without being embarrassed, the Prime Minister, stated: “If someone is destroying cars, is aggressive and even bites a policeman, then they cannot expect to be treated with kid gloves”. Wretched!
The Council of Europe does not believe the official version and in a statement (of which Czech TV received a copy) stated: “The Council of Europe is calling for an urgent, thorough, and independent investigation into the recent death of a Romani man in the Czech Republic after he had been apprehended by the police. Footage taken on 19 June from Teplice, Czech Republic, showing police intervention against a Romani man who later died in an ambulance is alarming and raises numerous questions about the circumstances of this tragic incident.”
From Spain, we will complain to the European Parliament and the Council of the European Union. We will also complain to the United Nations Human Rights Council that is based in Geneva and we will urge the International Romani Union to mobilize Roma citizens from all over the world to take part in a civic and peaceful protest to stop police brutality.

Una muerte aborrecible, brutal e inhumana
La muerte de Stalisnav Tomás, un hombre gitano de 46 años a manos de la policía checa ha sido calificada como “aborrecible, brutal e inhumana”.
Las imágenes que han llegado hasta nosotros y que se han difundido por todo el mundo son escalofriantes. Antena3 de TV nos ha mostrado un vídeo casero en el que se ve como un policía checo asesina a un hombre gitano poniéndole una rodilla en la garganta hasta asfixiarlo. Lo he visto un par de veces porque no me podía creer lo que veía. El desgraciado Stalisnav, tumbado en el suelo con tres energúmenos uniformados encima. Uno le sujetaba los pies para que no pudiera hacer el intento de levantarse, otro lo empujaba por la espalda contra el suelo con el fin de que permaneciera bocabajo mientras que el tercero, arrodillado junto al pobre desgraciado, le situaba su maldita rodilla en el cuello presionándole la nariz y la boca contra el suelo hasta que dejó de respirar.
Ahora la policía dice que murió en la ambulancia. ¡Mentira! Otros dicen que murió en el hospital. ¡Mentira! Los testigos que vieron como se consumaba el asesinato afirman que el pobre gitano, cuando le faltó el aire, lanzó un lamento de dolor e inmediatamente dejó de hacer el más mínimo movimiento. Y así permaneció hasta que la ambulancia llegó para llevarse el cuerpo. Ya estaba muerto.
No hace falta haber estudiado Derecho para saber que estamos ante un asesinato en el que concurren, entre otras, las circunstancias de alevosía que contempla el artículo 139 del Código Penal. Si el agente tuviera que ser juzgado en España cabría añadirle a la acusación que su delito se vería agravado por haber actuado por motivos discriminatorios —raza, sexo, ideología, minusvalía, etc.— y prevalerse del carácter público que tiene el culpable.

El mundo entero se conmovió cuando vio el video en el que aparecía Derek Chauvin, policía de Mineápolis, apretando contra el suelo el cuello de George Floyd hasta causarle la muerte.
Por cierto, casualidades de la vida, acabamos de conocer la sentencia dictada por el juez Peter Cahill, del distrito del condado de Hennepin, Minnesota, condenando al expolicía a 22 años y medio de prisión. La fiscalía del lugar pedía 30 años porque, al margen de la gravedad del delito cometido, los ciudadanos del país vieron que la historia de los Estados Unidos se degradaba por los abusos policiales y las agresiones racistas que se prodigaban con demasiada frecuencia. Y no lo olvidemos: los otros tres policías que intervinieron han sido acusados de complicidad y serán juzgados por separado el próximo mes de agosto.
Creíamos que estas cosas ya no pasarían.
Creíamos que la humanidad había quedado inmunizada frente al racismo asesino tras tener conciencia del horror que supuso el genocidio nazi durante la Segunda Guerra Mundial. Nos sobresaltamos cuando el anterior ministro del Interior, Matteo Salvini, propuso hace tres años realizar en Italia un censo para tener controlados a los gitanos y las gitanas del país vecino. Simultáneamente un correligionario suyo, alcalde de Treviso, Roberto Maroni, dijo tener la solución para acabar con el problema gitano: eliminar a los niños o vestirlos de conejos para que los cazadores pudieran empezar a disparar. Otros, como Nicolas Sarkozy, presidente del gobierno francés, decretó en julio de 2010 la expulsión del país de los gitanos llegados de Rumanía y Bulgaria, a causa de las protestas ejercidas por los gitanos de Saint-Aignan porque un policía disparó y asesinó por la espalda a Luigi Duquelnet, un joven gitano de 22 años, que huía junto a su hermano Miguel de una embestida policial.
Pero la brutalidad policial, consentida y a veces protegida por algunos gobiernos no ha acabado ahí. En España tenemos pendiente de aclaración la denuncia penal interpuesta por la Asociación de Juristas Gitanos ante la Fiscalía de Delitos de Odio de Cádiz por el fallecimiento de Daniel Jiménez el pasado 1 de junio en la Comisaría de Algeciras. El motivo de esta denuncia, explica la asociación, es «la sospecha de que su muerte hubiera podido tener una causa distinta a la del suicidio y a fin de depurar las responsabilidades penales y civiles que correspondan, si las hubiera».
¿Tienen los cuerpos de policía carta blanca para actuar con violencia extrema contra los gitanos?
Creo que no es necesario a estas alturas que me tenga que disculpar porque alguien piense que estoy acusando de forma indiscriminada a toda la policía. Los cuerpos y fuerzas de seguridad del Estado son necesarios y solo ellos pueden usar legítimamente la violencia para imponer el cumplimiento de la Ley y defender a los ciudadanos cuando su integridad o sus libertades están siendo atacadas por otros ciudadanos.
Pero no nos engañemos. Cuando los gobiernos son tolerantes o miran para otro lado cuando algunas fuerzas políticas actúan con violencia contra quienes no piensan como ellos, las fuerzas de seguridad pueden experimentar un impulso de agresividad a la vista de que quien debe regular el uso de la fuerza siempre encuentra disculpas para no hacerlo.
Tal es el caso de Hungría, esa tierra entrañable por la que todos los gitanos del mundo sentimos cariño y admiración, pero que hoy está gobernada por un peligroso individuo, Viktor Orban, al que dos presidentes de Gobierno europeos, Mark Rutte, primer ministro holandés y Xavier Bettel, primer ministro luxemburgués, han invitado a marcharse de la Unión Europea. Estos vientos son los que causan tempestades como la denunciada, hace unos años, por la Unión para las Libertades Civiles (TASZ). En un año se han registrado más de 50 actos violentos contra la población romaní, que causaron la muerte de siete personas, según datos de la TASZ, mientras que esa cadena de violencia culminó con el asesinato de un gitano y de su hijo de cinco años.
Europa se moviliza por la muerte de Stalisnav Tomás
Los gitanos alemanes ya han reaccionado. Romani Rose, líder del Consejo Central de los gitanos alemanes se ha entrevistado con el embajador checo al que ha entregado una carta para el ministro del interior en la que expresa “Nuestra principal demanda es que esto sea investigado por una comisión independiente, así como que se tomen las medidas correspondientes contra el comportamiento inaceptable de los agentes de policía”.
Y la indignación crece cuando nos enteramos de que el primer ministro de la República Checa, Andrej Babis y el ministro del Interior han felicitado a la policía por su acción. El presidente del Gobierno, con absoluta desfachatez, ha declarado que “Si alguien es agresivo e incluso muerde a un oficial de policía, no puede esperar que lo manejen con guantes de niño”. ¡Miserable!
El Consejo de Europa no se cree lo que dicen las autoridades como lo demuestra la declaración del histórico organismo de la que la TV checa ha recibido una copia: “El Consejo de Europa pide una investigación urgente, exhaustiva e independiente sobre la reciente muerte de un gitano en la República Checa después de haber sido detenido por la policía. Las imágenes tomadas en Teplice, República Checa, muestran a la policía interviniendo contra un hombre gitano que luego murió, lo que es alarmante y plantea numerosas preguntas sobre las circunstancias de este trágico incidente.”
Nosotros, desde España, acudiremos al Parlamento Europeo y al Consejo de la Unión Europea. Igualmente acudiremos al Consejo de Derechos Humanos de las Naciones Unidas que tiene su sede en Ginebra e instaremos a la Unión Romani Internacional para que movilice a los gitanos de todo el mundo en una protesta cívica y pacifica que ponga freno a la agresividad policial que padecemos en demasiados lugares del mundo.
